International criminal law is advancing rapidly. Eleven years ago a Bosnian concentration camp guard named Dusko Tadic became the first person ever convicted in an international criminal tribunal set up by the United Nations. The court that tried Tadic, the International Criminal Tribunal for the former Yugoslavia (ICTY), remains in operation, alongside similar UN tribunals for Rwanda and Sierra Leone. Meanwhile, a permanent International Criminal Court (ICC), just four years old, has been joined by 100 countries. Its first defendant, Thomas Lubanga of the Democratic Republic of the Congo, now awaits trial in The Hague. There are two common ways of justifying international criminal trials. One is to argue that certain crimes constitute such a grave moral and political evil that they require a response from the international community. They are, as we say, crimes against humanity. The other is to argue that international criminal trials are needed to deter actors who would otherwise perpetrate crimes with impunity--violent aggressors who fall through the cracks (or gaping holes) of national justice systems because their governments are either unwilling or unable to pursue criminal sanctions. Larry May prefers the first of these two justifications, and makes it the basis of his normative theory of international criminal law. (1) His belief that international criminal law should confine its jurisdiction to acts that injure humanity as a whole explains the dual purpose of the book, which is to defend the use of international criminal trials while simultaneously scaling back their operation.
